Federal Emergency Paid Sick Leave
Provides sick time to employees unable to work or telework due to a need to leave based on specified COVID-19 related reasons. This legislation goes into effect on April 1, 2020 for employers with less than 500 employees. Under this legislation the Federal Emergency Paid sick leave must be used first prior to other paid time off available through the employer. There is a 100% tax credit available for employers who pay employees emergency paid sick leave. Employers are encouraged to track this time separately for documentation purposes.
Federal Emergency Family and Medical Leave Expansion Act
Provides unpaid and paid leave under the Family Medical Leave Act (FMLA) for employees who are unable to work or telework due to a need for leave to care for a minor child if the child’s school or place of child care has been closed or is unable to do a public health emergency. This legislation goes into effect on April 1, 2020 for employers with less than 500 employees. Employee are eligible for this benefit if they have worked for the employer for at least 30 calendar days
There is a 100% tax credit available for employers who pay employees emergency paid sick leave. Employers are encouraged to track this time separately for documentation purposes.

New York State Covid-19 Paid Sick Leave
Governor Cuomo signed legislation on March 18, 2020 that provides guaranteeing job protection and pay for New Yorkers who have been quarantined due to the novel Coronavirus. The amount of paid sick leave an employer is required to provide is based on the number of employees a company. The New York Stat Coivd19 Paid Sick Leave is available for employers with less than 500 employees
